He formed the first investigative unit in the Justice Department which later became the FBI. He fervently prosecuted atrocities committed by the Ku Klux Klan and injustices brought on by powerful railroad interests. These actions led to his forced resignation. Although a New Hampshire native, he returned to his first Georgia home in Elberton but was not welcomed because of his stance on rights for African Americans. He moved his family to Cartersville for its milder political climate and practiced law here until his death in 1880. He is interred in Cartersville's Oak Hill Cemetery.
